The Immigration, Asylum and Nationality Act 2006, introduced in February 2008, a new criminal offence for employers who employ illegal workers. The maximum civil penalty was also increased from £5,000 to £10,000 for every illegal worker found to be employed in the UK.
Know the rules:
You, as the employer must, as part of your recruitment process check the eligability of a prospective employee to work in the UK. The checks must be carried out BEFORE the employee starts working with you.
There are two lists of acceptable documents for checking identity. List A contains such items as a British Passport, which have no time limits on working in the UK. List B contains a list of documents which carry restrictions on the amount of time individuals will be able to spend in the UK.
You can access these lists through the Business Link website.
